Patents Examiner ANZSCO Code 224914

A Patents Examiner is a professional with specialisation to assess the patent applications and decide whether the inventions should qualify as a patent. As employees in the offices of intellectual property or other regulatory authorities. Patent examiners are very instrumental in protecting the concept of innovation by ensuring that patents awarded are new, innovative and industrially viable. Patents Examiners look at the detailed technical descriptions, drawings and claims made by the inventor or patent lawyer. They run intensive searches of prior art to determine the existence of similar inventions, searching national and international patent databases, scientific literature and technical literature. Based on this review, they evaluate adherence to patent legislation and submit reports of examination with a description of findings, opposition or endorsement.

Another major aspect of the job is the application of scientific, engineering or technical skills in interpreting the complicated inventions found in mechanical engineering, electronics, biotechnology, chemistry or information technology. Patent examiners should also understand legal frameworks correctly, though with a clear comprehension of technical terms. They further send e-mails and letters to applicants or law firms in response to amendments, clarifications and formal communications when going through the examination process. This position requires good analytical skills, a keen eye and the ability to communicate well through writing. Examiners should come up with well-articulated reports that are transparent and explain the decision made. Time management is also significant since they may be dealing with several applicants with specific examination schedules. Besides the examination responsibilities, Patent examiners can also take part in the policy formulations, quality checks and improvement efforts in intellectual property offices.

They are informed about the developments in patent laws, new technologies and new methods of international examination. A Patent Examiner is an agent of innovation and economic development because they make sure that patent rights are assigned on a reasonable and correct basis. They are used to uphold the integrity, reliability and credibility of the patent system through strict analysis and legal supervision.
